Terms and Conditions
Villas Guzmán is a registered and authorized company managing tourist accommodations, providing professional hosting and cleaning services with dedicated staff and protocols, as well as maintenance and assistance throughout your stay with services such as customer care and weekly linen changes. This constitutes a lodging service subject to the reduced VAT rate of 10%, regardless of the length of stay or applicable regime (VUT or rental contract).
Depending on the duration of your stay, this contract is categorized under a different modality:
- If your reservation is for up to 10 nights, it is considered a tourist housing rental (VUT).
- If your reservation exceeds 10 nights, it is considered a lodging contract, with services similar to those of the hotel industry, according to current regulations in the Valencian Community.
In both cases, this contract sets forth the general conditions of the stay.
We need you to sign it during your Check-in OnLINE as acknowledgment and acceptance.
The client declares having read and accepted these conditions through electronic signature or explicit acceptance during the online check-in process.
General Booking Conditions. Booking Contract.
1. Definitions:
1.1. Accommodation: Tourist housing managed by Villas Guzmán and legally registered for its short-term rental, equipped and prepared for guest use, offering complementary hosting services.
1.2. Accommodation provider: The actual provider of the Reserved Accommodation who also handles service provisions such as key delivery, cleaning, maintenance, etc.
1.3. Booking agent: The landlord itself, possibly an intermediary, or another independent organization in charge of the administrative processing of the reservation and who receives payments.
1.4. Tenant: The individual listed in the reservation form who makes the reservation, as well as the occupants of the accommodation.
1.5. Rental price.

1.8. Landlord / Service provider: Alquileres Guzmán S.L., a duly registered management company providing hosting services and acting on behalf of the property owner.

2. Scope of application:
This general reservation conditions apply to all reservation contracts between the Tenant and the Landlord, distinguishing between tourist housing rental (up to 10 nights) or lodging contract (more than 10 nights) according to applicable regional legislation.
3. Formation of the reservation contract:
When the tenant makes a reservation via Internet, in writing, by phone, email, or in person with the Landlord or another booking agent, a contract incorporating these general reservation conditions shall be considered concluded. It is strictly forbidden to make more than one reservation in different accommodations on the same dates unless the full amount is paid at the time of booking or with explicit permission from ALQUILERES GUZMAN.
4. Modifications:
Amendments to the reservation contract and exceptions to these general conditions are valid only if agreed upon in writing between the landlord or booking agent and the tenant.
5. Payment conditions:
The agreed advance, usually 10% of the rental amount, must be held by the booking agent within 3 business days after making the reservation. The remaining amount, along with extras, is payable thirty days before arrival.
5.1. Damages: Villas Guzmán reserves the right to claim damages through the appropriate channels for any breakage or damage caused during your stay due to mistreatment or misuse of the accommodation.
6. Price:
Prices are in euros. We reserve the right to alter the accommodation price based on rates, taxes, or regulatory changes. The tenant may cancel if the increase occurs within three months of the reservation.
7. Termination:
The contract will be terminated if the tenant fails to comply with payment terms. Account payments will then be used to cover incurred expenses and damages, including loss of amenities.
8. Cancellation:
Free cancellation up to 30 days before arrival. After that, penalties ranging from 50% to 100% apply. Between 29 and 14 days before arrival: 50% cancellation fee of the total stay. - 13 days before: Cancellation fee equal to the total amount of the stay. - No show: Cancellation charge of the total stay amount. If the client voluntarily leaves the accommodation early, for any reason or circumstance before the contract ends, the company is exempt from any refund for this reason.
9. Insurance:
No cancellation insurance is offered except as indicated in the cancellation conditions.
10. Landlord’s responsibility:
Villas Guzmán is responsible for ensuring that the villa description matches the general characteristics of the property, though there may be some modifications regarding furniture or decor over time, as owners may change or renew them due to deterioration. Villas Guzmán is not responsible for any modifications affecting the property (furniture, decor, facilities, appliances) or its surroundings that are not contractual and will not accept penalties from the guest.
11. Guest’s responsibilities:
All occupants and the reservation person or entity, whether or not they occupy the property, are jointly responsible for the total rental fee and damages caused by their conduct and that of others staying with them. Trash must be disposed of in the nearest bin. The reservation is valid for the number of persons indicated in the reservation form. Therefore, occupancy exceeding this number may lead to contract termination and loss of the deposit. Parties or events are not authorized. Violations of basic conduct rules, such as excessive noise or music, that disturb neighbors or authorities, may result in deposit loss and immediate cancellation. Many towns conduct noise campaigns; guests may be fined directly by authorities. Payments will not be refunded in these cases. If the tenant plans to host more people than allowed, they must submit a written request to the booking agent before the rental period starts. The accommodation provider may decline or charge additional fees. The tenant agrees to abide by current regulations during occupancy. Villas Guzmán will only provide a key copy. Additional copies may be provided depending on the property. Loss of keys or failure to return them will incur a €100 fee.
12. Security deposit:
In case of damages or losses due to the tenant’s fault or negligence (including the reservation individual and occupants), the deposit will be used to cover the total damage cost. If damages exceed the deposit amount, the tenant must pay the difference directly to the accommodation provider. Breakages, losses, or damages must be reported within 48 hours to the provider and compensated. For short stays (days or weeks), only a credit card deposit is required, refundable after at least 3 days and up to a week after departure, if everything is in perfect condition. Longer stays of at least 2 months will require a security deposit via credit card covering potential damages, retained until appropriate invoices are received. Additional charges may be deducted periodically from the provided credit card. If damages exceed the deposit, the tenant must pay the difference immediately; otherwise, legal action may be taken. A special security deposit applies to youth groups and special events, ranging between €100 and €300 per person depending on the property’s quality, to ensure its condition.
13. Check-in and check-out:
Standard check-in from 17:00. Check-out before 10:00. Unjustified delays may incur penalties. Check-out must be before 10:00, returning keys to the agency. Otherwise, the accommodation provider may charge damages. The provider has the right to perform a final inspection. Guests must leave the property reasonably tidy and undamaged. Furniture and items inside and outside should remain in original places; otherwise, a €60 fee may be charged. Leaving trash inside the property incurs a €60 fee.
14. Documents:
General information about the accommodation will be provided to the guest at the time of booking.
15. Replacement of accommodation:
Villas Guzmán may replace the reserved accommodation due to unforeseen serious circumstances preventing the guest's full enjoyment, with another similar property. The previous occupant’s failure to vacate the property will also be considered included.
16. Incidents:
Despite our maintenance team’s ongoing efforts, issues may arise that are not immediately detectable or are harder to identify during high season. If you notice any faults or deficiencies, notify the provider or local booking agency within 48 hours to allow repairs. Contact [email protected], including the villa name, reservation dates, detailed issues, and priority ones. Photos are appreciated. After 48 hours without notification, Villas Guzmán will assume the property is in perfect condition. Early departure or changing accommodation without consulting the booking agent forfeits rights. Any cleanliness issues must be reported immediately; complaints after 24 hours will not be accepted. Guests must understand that properties can experience breakdowns or issues beyond our control, such as septic tank problems, pipe breakages, water heater failures, etc., requiring prompt attention. Resolution times may vary, especially during high season, and responsibility for delays or issues outside our control is disclaimed. It is important to note that works and renovations in private properties or surroundings are outside Villas Guzmán’s control and are not responsible for inconveniences caused by such works.
17. Cleaning:
Included in the contract, but penalties apply if the property is left in poor condition. Extra cleaning services can be hired in advance at an extra cost.
18. Bedding and towels:
Included with the rental. Weekly linen changes require a 1-day prior notice, not accepted on Saturdays.
19. Additional facilities:
Requests such as baby cots or high chairs can be made at the time of booking, subject to availability and additional charges.
20. Pets:
Pets are allowed only with explicit approval from the accommodation provider and must be indicated in the reservation certificate. The extra fee is €50 per animal. Failure to notify the presence of a pet may result in a €150 charge per animal.
21. Comfort level:
Indicative and subjective, based on company standards.
22. Satellite TV:
If indicated in the description, it does not automatically guarantee access to all programs.
23. Water and electricity:
Power and water supply outages are more common in southern countries. Local or regional authorities may temporarily cut or limit distribution for various reasons. Neither the accommodation provider nor our organization can be responsible for damages caused.
VEHICLE CHARGING IS STRICTLY PROHIBITED IN THE ACCOMMODATION.
24. Pool:
Pool maintenance is performed once or twice a week. Maintenance hours are from 07:00 to 10:00 or 19:00 to 21:00, but may vary. Pool and garden staff may access the property to perform necessary work without prior notice. If the pool is dirty or issues are observed, contact the office immediately. Any client manipulation may incur penalties. Shower before entering the pool to remove creams or oils. Excessive use of certain products can turn the pool green for up to 3 days; the guest is responsible for this.
25. Jurisdiction and applicable law:
For any disputes, the parties expressly submit to the Courts of Denia (Alicante-Spain) and their hierarchical superiors, waiving their own jurisdiction if applicable, and applying Spanish law on substantive and procedural matters. The landlord may accept the address provided by the tenant, but if located abroad, the tenant may choose their nearest Consulate’s address. For unspecified issues, provisions of the Civil Code and Decree 10/2021 of January 22 of the Generalitat Valenciana’s Council apply, regulating tourist accommodations and management companies within the Valencian Community. Depending on the length of stay, this contract is governed as a tourist rental (VUT) or lodging contract, per Decree 10/2021 and related regulations.
26. Wi-Fi: Wi-Fi is for general data use.
The Wi-Fi service is external; our company is not responsible for line disruptions or failures, but will act promptly to resolve issues within our control.
27. Accidents and thefts:
By making a reservation, the guest assumes full responsibility for their personal safety and belongings. Neither Villas Guzmán nor the property owner is liable for any damage, injury, illness, death, material damage, or theft experienced during the stay.
28. No unwarranted compensation requests will be accepted through formal procedures.
Any coercion or blackmail threats via negative review publication will be reported to the authorities.
29. Breach:
Violation of these conditions may result in Villas Guzmán ordering eviction and canceling the rental, along with losing the deposit.
30. Basic data protection information (Regulation (EU) 2016/679 of April 27, 2016):
ALQUILERES GUZMAN SL is responsible for processing your personal data to manage reservations and bookings requested, based on the legal basis of executing a contract wherein the data subject is a party. Your data will not be transferred unless legally required. You have rights of access, rectification, cancellation, opposition, portability, and limitation, which can be exercised at our offices or via email [email protected]. More information on data processing can be found in our Privacy Policy. The purpose of data processing is to manage booking and accommodation rentals for your stay, accounting, tax management, and sending promotional communications related to real estate rentals via the email provided. The legal basis is the execution of the contract and legal obligations. Data will be retained as long as our contractual relationship persists; after termination, for four years for tax purposes and six years for commercial purposes, according to applicable laws. Data are provided by you. Data recipients include partner companies managing reservations, tax authorities, and banking entities for payments. No international data transfers will occur. You can file a complaint with the Data Protection Agency if your rights are not properly addressed.
